ACCESS TERMS

Welcome to the Defenders of Health website available at defendersofhealth.co.uk (the “Site”). The Site is operated by the Bill & Melinda Gates Foundation (the “Foundation”) and its service providers in collaboration with certain partners listed on the Site, which may be updated from time to time (together, “we”, “our” or “us”).  The Site was created to provide an educational adventure web game that takes parents/guardians on a journey with their child to discover the ways health professionals are saving lives around the world. For sake of clarity, the Site is not intended for minors (individuals under the age of 13, or equivalent minimum age depending on jurisdiction) to use without the supervision of a parent/guardian.

This page sets out the specific terms and conditions (“Access Terms”) applicable to all users’ (“you”, “your”) access and use of the Site and information about how your personal data may be used in particular ways when you use the Site (“Privacy Statement”).

These Access Terms are supplemental to the general terms and conditions  applicable to websites operated by the Foundation, including the Bill & Melinda Gates Foundation Terms of Use (“Terms of Use”). In the same way, the Privacy Statement below applies in addition to the privacy notices applicable to websites operated by the Foundation, including the Bill & Melinda Gates Foundation Privacy & Cookies Notice  (“Privacy & Cookies Notice”). The Terms of Use and the Privacy & Cookies Notice are incorporated in to and form a part of these Access Terms and the Privacy Statement.

By using the Site, you confirm that you accept these Access Terms and the Privacy Statement (including the Terms of Use and Privacy & Cookies Notice, which are incorporated by reference) and that you agree to comply with them. These terms and conditions will apply to any use of the Site, whether as a guest or a registered user, and including accessing, browsing, or registering to use the Site (where applicable). Please read them carefully and make sure that you understand them before using the Site.  If you refuse to accept these terms and conditions, you must not use the Site.

We may amend these Access Terms and/or the Privacy Statement from time to time. Please check this page regularly to ensure you understand the terms and conditions which will apply at any particular time. 

Capitalised terms used below that are not defined in these Access Terms or the Privacy Statement shall have the meanings given to them in the Terms of Use or the Privacy & Cookies Notice, as applicable.

1. Permitted Use of Content on the Site

Subject to the ‘Restrictions on Use of Content’ section of the Terms of Use, you may review, download, copy, distribute and use the Available Content for your own personal use, in addition to any governmental or charitable purposes referred to in the Terms of Use.

2. User Generated Content and NTD Procedure

As mentioned in the ‘User Generated Content and Site Activities’ section of the Terms of Use, we may (but are not obliged to) monitor the use of the Site from time to time, and we may modify (before or after posting to the Site) or remove any Content posted by any particular user of the Site (“User Generated Content”). However, we rely on you to inform us of any abuse or inappropriate Content on the Site, in which case we may review specific Content posted by any user of the Site. In this respect, we operate a “notice and take down” procedure (“NTD Procedure”) which you agree to use as the sole remedy in respect of any User Generated Content which causes you concern or to which you object on legal or other grounds.

The NTD Procedure shall operate as follows:

(b) you must notify us immediately upon becoming aware of any User Generated Content to which you have any concern or objection at [email protected]  (“Objection”);

(b) we shall endeavour to review the User Generated Content and may take such action as we deem appropriate (including removal of the User Generated Content, or rejection of your Objection);

Unless otherwise specified in the Objection, you acknowledge that we have the right to disclose your identity and contact details to the person responsible for any particular item of User Generated Content. We reserve the right to refuse to disclose, unless compelled to do so by law, the identity or contact details of any person who is responsible for User Generated Content.

3. Exclusion of liability regarding healthcare information Without prejudice to the Terms of Use (and in particular sections 7 to 10 concerning indemnification, warranties, etc., damages and remedies), the Site is not intended to provide medical advice of any kind, and we accept no responsibility to you or any third party in connection with any Content which refers to healthcare treatments, procedures, systems, methods, medicines, or any other information of a medical nature or related to health, whether such Content was posted on the Site by us or by any user of the Site.

4. Linked sites including social media Please note that the Content featured on the Site may be replicated or supplemented on third party social media websites, including Facebook, Instagram and Twitter, which are governed by, and require your agreement to, different terms and conditions. You should carefully review such terms and conditions when you are redirected to such linked sites.

This Privacy Statement supplements the Privacy & Cookies Notice using the same headings (but without repeating each and every heading).

What data we collect about you

Data you provide yourself

If you are a visitor to the Site who is over the age of eighteen (18) and wishes to add your name to a petition/open letter which will be sent by us to your respective Member of Parliament (MP), we will ask for the following personal data about you: name and postcode.

Data we collect upon opt-in, including cookies and similar technologies

We may collect some personal data, including your Internet Protocol (IP) address, if you opt-in to such collection. When you visit the Site and opt-in, the Site uses cookies to tell us about how you are using the Site. We also use certain cookies provided by third party providers, including Google and Facebook, to help us to see how many times the Site is visited, which parts of the Site are most popular, and in some cases, how you arrived at the Site.

How we use your data

Additional purposes

If you are a visitor, we may use your personal data to add your name to the petition/open letter and administer the sending of such petition/letter to your respective MP.We may also use your personal data to keep in touch with you for follow-up purposes.

Where you have opted in to receive updates or a response from your Contact Us submission, we will send these to the email address you have provided to us. You can opt out from receiving updates using links within each newsletter email or by contacting us at: [email protected]

Legal bases under the GDPR

Our processing of your personal data for the above additional purposes is necessary for our legitimate interests (including our interests in operating the Site and promoting the important work of healthcare professionals), with the exception of sending you updates by email and facilitating the engagement with your MP, which relies on your consent.

When we share your data

Employees, agents, affiliates, service providers, and partners

We receive assistance with the administration of the Site from third party services providers who are data processors for the purposes of applicable data protection laws, including the GDPR. These services providers may only use your personal data on our behalf.

We will share your personal data (name and postal code) with your respective MP (based on the postal code you provide) in order to submit the petition/open letter. In this case, we may share your personal data with third parties who are data controllers for the purposes of applicable data protection laws, including the GDPR. In such cases, the privacy notices (and privacy policies, privacy statements, etc.) of those third party data controllers will apply to the use of your personal data and you should refer to those in addition to this Privacy Statement and our Privacy & Cookies Notice.

Respective Members of Parliament

We will share your personal data (name and postal code) with your respective MP (based on the postal code you provide) in order to submit the petition/open letter. In this case, we may share your personal data with third parties who are data controllers for the purposes of applicable data protection laws, including the GDPR. In such cases, the privacy notices (and privacy policies, privacy statements, etc.) of those third party data controllers will apply to the use of your personal data and you should refer to those in addition to this Privacy Statement and our Privacy & Cookies Notice.
